Terms of service

The agreement between Wonderbooth and the operators and guests who use it.

Agreement

These terms are between you and Bird In The City LLC ("we"), which makes Wonderbooth. They govern your use of Wonderbooth: our websites, the operator dashboard, the booth app, and the photo links we send. By creating an account or using the booth, you agree to them. If you use Wonderbooth for a business, you agree on its behalf.

The service

Wonderbooth is photo booth software. Operators set up events in the dashboard and run the booth on an iPad, with or without a tethered camera. Guests take photos, choose a look, and receive their photos by QR code, AirDrop, text or email.

Wonderbooth is in private beta. Features will change, and some may be added or withdrawn as we approach launch.

Accounts

You need an account to set up events. Keep your sign-in details secure and tell us promptly if you think someone else has used your account. You're responsible for what happens under your account, including on the booth devices you pair to it.

Operators’ responsibilities

When you run Wonderbooth at an event, you are responsible for:

  • Telling guests that photos are being taken and how they'll be used, and getting any permission the law or the venue requires, including a parent's permission for children.
  • Using the guest contact details collected at your events only to deliver their photos, unless the guest has separately agreed to more.
  • Complying with the laws that apply to your events, including privacy, consumer and marketing laws.
  • The content you upload, such as invitations, logos and backgrounds, and having the rights to use it.

Photos and content

Operators and guests keep whatever rights they have in their photos and uploads. You give Wonderbooth permission to store, process, style, display and deliver them, only as needed to provide the service and for as long as the event's retention period allows.

We don't use guest photos for advertising or to train AI models.

AI looks

AI looks are generated automatically and can be imperfect: a likeness may drift, or details may be wrong. Operators decide which looks their booth offers and may switch AI off for an event. Don't use Wonderbooth to create images meant to deceive, harass or sexualise anyone.

Acceptable use

Don't use Wonderbooth to break the law, to infringe anyone's rights, to collect contact details for marketing without consent, to send messages people didn't ask for, to probe or overload our systems, or to resell the service without our agreement.

Fees

The private beta is free. Paid plans will be offered at launch, with features and capture resolution set by plan. We'll tell operators before any charge begins, and nothing is charged without your agreement.

Text messages

Guests who enter a mobile number at the booth receive a text with a link to their photos. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help. The full terms for those messages are on Text messages.

Disclaimers

Wonderbooth is provided as is and as available. Events happen in places with unreliable networks, power and hardware, and we can't promise the service will be uninterrupted or error-free. Keep your own backups of anything you can't afford to lose.

Limitation of liability

To the extent the law allows, Wonderbooth is not liable for indirect, incidental or consequential losses, or for lost profits, revenue or data. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, or US$100 if that is greater.

Ending your use

You can stop using Wonderbooth and close your account at any time. We may suspend or close an account that breaks these terms or puts guests or the service at risk, and will tell you why unless the law prevents it.

Changes

We may update these terms as the service develops. We'll update the date at the top and tell operators by email before a significant change takes effect.
